Types of Accessory Dwelling Units Allowed

Encinitas accommodates both attached ADUs and detached ADUs to meet varied homeowner needs and lot configurations. State regulations allow for the maximum construction of two Accessory dwelling units, one of which can include a junior accessory dwelling unit (JADU).

Attached units share structural elements with the existing primary residence, while detached units stand independently on the property, offering flexibility in design and use. 

Under California law, the maximum size for attached ADUs is set to up to 50% of the floor area of the existing main residence. They must include their own living, sleeping, and cooking arrangements.

Junior Accessory Dwelling Units (JADU's) 

JADU’s differ from traditional Accessory Dwelling Units (ADUs) despite recent legislative changes that affect both. JADUs are smaller units created within the footprint of an existing single-family home, often converting spaces like garages or basements into independent living quarters within an existing primary residence.

Unlike ADUs, which can be up to 1,200 square feet in size and stand alone on a property, JADUs are limited to 500 square feet or 50% of the existing home’s living area, whichever is less. This distinction ensures that JADUs maintain a smaller scale and are integrated within the primary residence. 

JADU's also promote affordable housing solutions without significantly altering neighborhood density or character.

Size and Setback Requirements

ADU size is capped at 1,200 square feet or 50% of the primary dwelling’s floor area, whichever is less, ensuring proportional development.

Setback requirements specify minimum distances from property lines, safeguarding privacy and minimizing visual impact on neighboring properties. ADUs in Encinitas are required to maintain a minimum setback of 4 feet from rear and side-yard property lines. 

If an ADU utilizes these 4-foot setbacks, it must not exceed a height of 16 feet. ADUs taller than 16 feet must comply with the setback requirements specified by the underlying zoning regulations.

Additionally, it's important to note that street-side setbacks exceeding 4 feet do not apply in Encinitas. This means that even on a corner lot, ADUs can be constructed with a minimum 4-foot side setback, ensuring flexibility in property development while adhering to local zoning standards.

Height Requirments

Height restrictions typically permit one or two stories based on the zoning district and lot size. This ensures that ADUs blend harmoniously with surrounding properties while maintaining aesthetic and structural integrity.

Homeowner Occupancy Requirements

Parking

In Encinitas, ADUs are exempt from parking space requirements under the following circumstances:

  1. When located within a one-half mile walking distance from public transit, such as bus stops.
  2. Within designated historic districts recognized by the city.
  3. When converted from existing space within the primary residence or an accessory structure, or when attached to an existing or proposed primary residence. Additionally, exemptions apply if the ADU is part of a property that already has a primary residence.

These exemptions reflect efforts to reduce parking demands and promote sustainable transportation options while accommodating ADU development in Encinitas.
